Plain-language background: How PayoutProofs delivers futures signals.
These Strategy Subscription Terms (the “Terms”) govern your subscription to an independent analyst’s trading strategy (an “Analyst Strategy”) delivered through PayoutProofs. They are part of the PayoutProofs Terms of Service and Privacy Policy. Where these Terms conflict with those documents, these Terms govern strategy subscriptions.
Summary of the key points. (i) Each analyst is an independent trader who creates and is responsible for his or her own Analyst Strategy, including when to close a trade. PayoutProofs provides the technology platform. (ii) Every subscriber to an Analyst Strategy receives the identical signals. Nobody at PayoutProofs or among the analysts sizes signals for you or advises on your account. (iii) When you subscribe you choose one of two standard feeds: the Analyst Feed, which follows the analyst’s own exits, or the Day-Close Feed, which adds a standard close instruction at 4:50 PM ET. Everyone on the same feed receives the same instructions at the same time. (iv) You choose your own destination, your own position size and your own limits. If you connect a webhook to your own automation, you confirm a Webhook Delivery Authorization (Section 4.6) and a daily loss limit acknowledgment (Section 4.7). (v) You pay a fixed monthly price that renews automatically until you cancel, which you can do online at any time with one tap. (vi) Disputes are resolved by individual arbitration unless you opt out (Section 16).
1.1 The Analyst. Each analyst listed on PayoutProofs (an “Analyst”) is an independent trader, not an employee or agent of PayoutProofs. The Analyst alone decides the content and timing of the signals in his or her Analyst Strategy, including when to exit a position, and sets the monthly price for his or her subscription. Each Analyst is responsible for his or her own registration with the Commodity Futures Trading Commission and membership in the National Futures Association, or for qualifying for an exemption from registration.
1.2 PayoutProofs. PayoutProofs (“PayoutProofs,” “we” or “us”) operates the platform: the web room, signal delivery to the destinations you choose, the public analyst records and the tools described in these Terms. PayoutProofs does not create the Analyst’s signals, does not select which Analyst Strategy you follow, and does not provide advice about your account. The only instruction PayoutProofs itself issues is the standard Session-Close Instruction in the Day-Close Feed described in Section 3, which follows a fixed, published rule and is identical for every subscriber on that feed.
1.3 No individualized advice. Neither PayoutProofs nor any Analyst knows, asks for or uses your account size, positions, balance, risk tolerance, risk settings or other personal circumstances in producing or delivering signals. Nothing on PayoutProofs is advice tailored to you. If anyone presenting himself or herself as an Analyst or as PayoutProofs staff offers you advice about your own positions, size, settings or account, please report it through the Report button or to [email protected].
1.4 No account access. PayoutProofs and the Analysts hold no funds for you, have no access to your brokerage account or automation service, do not ask for your broker or automation login, and have no authority to place, change or cancel orders in your account.
1.5 No affiliation with automation services or brokers. PayoutProofs is not affiliated with, endorsed by or a partner of TradersPost, Tradovate or any other automation service or broker, unless a listing expressly states otherwise. Those services are independent third parties that you choose and contract with directly.
2.1 The subscription. You are subscribing to one Analyst Strategy’s Strategy Signals (defined in Section 3), in the feed you choose under Section 3, for the monthly price shown before you subscribe and recorded on your subscription confirmation.
2.2 Delivery channels. Each Strategy Signal is (i) displayed in the Live tab of the web room, (ii) sent to you as a Discord direct message if you have Discord DMs turned on, and (iii) sent to any webhook destination you have saved under Section 4.6. The content of the Strategy Signal is the same on every channel and for every subscriber on the same feed.
2.3 Price does not depend on results or feed. Your price is the same whatever the signals’ results and whichever feed you choose. No fee is charged per trade, and no part of the price is a share of any profit.
3.1 Identical for all subscribers. A “Strategy Signal” is an Analyst’s entry, stop, target, partial exit, management or exit instruction, expressed in a standard form that is identical for every subscriber to that Analyst Strategy on the same feed. Entries are expressed for a reference size of one contract of the instrument named by the Analyst (the “Reference Size”). Partial exits are expressed as a percentage of the position (for example, “exit 50%”).
3.2 The Reference Size is not a recommendation. The Reference Size is a uniform format so that signals can be read by automation tools. It is not a recommendation that you trade one contract or any other quantity. You alone decide whether to act on a Strategy Signal and in what size.
3.3 Two standard feeds. Each Analyst Strategy is available in two standard feeds: (1) Analyst Feed — every Strategy Signal the Analyst publishes, including the Analyst’s own exits, whenever the Analyst chooses to make them; positions may be held past the session close if the Analyst holds them. (2) Day-Close Feed — the same Strategy Signals as the Analyst Feed, plus the Session-Close Instruction described in Section 3.4, and subject to the rules in Section 3.5. You choose your feed when you subscribe. The feed you choose is recorded on your subscription confirmation.
3.4 Session-Close Instruction. At 4:50 PM Eastern Time on each trading day, PayoutProofs sends every subscriber on the Day-Close Feed for that Analyst Strategy the same instruction to close, in full, every position opened from that Analyst’s entry signals that is still open in the Day-Close Feed at that time (the “Session-Close Instruction”). On a day when the exchange has scheduled an early close, the Session-Close Instruction is sent 10 minutes before the scheduled close. The Session-Close Instruction is a fixed, time-based rule published by PayoutProofs. It is not a decision by the Analyst and it is not based on market conditions, on any position’s profit or loss, or on any subscriber’s account.
3.5 Day-Close Feed rules. In the Day-Close Feed, (i) once the Session-Close Instruction has been sent for a position, no further Strategy Signals for that position (such as later partial exits, stop changes or exits) are sent, so that a later instruction cannot reopen or reverse a position, and (ii) no new entry signals are sent from the time of the Session-Close Instruction until the next trading session opens. These rules apply in the same way to every subscriber on the Day-Close Feed.
3.6 Changing feeds. You may switch between the Analyst Feed and the Day-Close Feed in your settings. A switch applies only to positions opened from entry signals sent after the switch. Positions already open continue under the feed in effect when their entry signal was sent.
3.7 No individual close orders. PayoutProofs does not send close, flatten or other order instructions on request for any individual subscriber, and the platform has no “close my trade” or “close all” function. To close or adjust a position at any time, use your own automation service or broker. Section 4.4 explains what happens if an exit instruction cannot be delivered.
3.8 Your destination decides what happens. Whether a Session-Close Instruction or any other Strategy Signal results in an order depends entirely on your own destination and broker settings. A Session-Close Instruction is not a guarantee that your position will be closed.
4.1 You choose your destination. You may save a webhook destination, such as an account with a third-party automation service. You choose that service, create the connection between it and your brokerage account, and control its settings. PayoutProofs is not a party to your agreement with that service or your broker, and you are responsible for complying with their terms.
4.2 You set your own size and limits. Any position sizing, quantity multiplier, maximum loss, daily loss limit, instrument filter or other rule that applies to your account must be set by you in your own destination or brokerage tools. PayoutProofs does not size, filter or skip signals for you.
4.3 What delivery means. A Strategy Signal is delivered when your saved destination accepts the message (for a webhook, an HTTP acceptance; for a Discord DM, a sent message). Delivery is logged with the time and destination. Delivery does not mean that an order was created, filled or protected. Whether and how your destination acts on a Strategy Signal depends entirely on your own settings.
4.4 Failed delivery. If a Strategy Signal cannot be delivered to your saved destination, PayoutProofs records the attempt, retries under its delivery policy and notifies you in the web room or by Discord DM where available. If an exit instruction or Session-Close Instruction for an open position cannot be delivered, you are warned so you can act at your broker.
4.5 Live tab and DMs. The Live tab and Discord DM copies are for information. A missed DM or a page that was not open does not affect delivery to your saved destination.
4.6 Webhook Delivery Authorization. Saving or changing a webhook switches that subscription off. Before PayoutProofs sends any Strategy Signal to a webhook, you confirm the following authorization by ticking the authorization boxes when you subscribe or switch the subscription back on. PayoutProofs records the date and time, the webhook (shown in masked form), the feed you chose, the Terms version and the IP address used. By confirming it, you state and agree that:
(i) You built the connection. You created the webhook and the connection between your chosen automation service and your brokerage account yourself. No one at PayoutProofs and no Analyst set it up, configured it, logged into it or chose its settings for you.
(ii) You control size and limits. You alone choose and maintain every quantity, multiplier, risk, loss-limit, filter and other setting in your automation service and at your broker. PayoutProofs and the Analysts have no access to those settings and give no advice about them.
(iii) Signals may become live orders. Depending on your own settings, a Strategy Signal or Session-Close Instruction delivered to your webhook may be turned into a live order in your account automatically, without any further confirmation from you or anyone else.
(iv) What you authorize. You authorize PayoutProofs only to transmit the Strategy Signals (and, on the Day-Close Feed, the Session-Close Instruction) for the Analyst Strategy and feed you chose to the webhook you saved. You do not give PayoutProofs, and PayoutProofs does not accept, any authority over your brokerage account.
(v) You can stop it at any time. You can remove or change the webhook at any time in your settings. Removing it stops delivery of future Strategy Signals to that webhook. It does not close or change any position or order already at your broker, which you must manage there.
(vi) You keep it secure. Your webhook address works like a key to your automation. You are responsible for keeping it private and for replacing it if you believe someone else has it.
(vii) You accept the risks. You have read and accept the risks in Section 10, including that automation can fail, duplicate, delay or reject orders, and that you must supervise your account.
(viii) Your account rules. Your broker, your automation service and any funded or evaluation account you trade permit you to receive and act on third-party signals in this way.
4.7 Daily loss limit step. Before you save a webhook, the setup screen asks you to set a daily loss limit in your broker’s or automation tool’s risk settings, and to confirm the acknowledgment in Exhibit B. PayoutProofs records the acknowledgment separately each time you save a webhook, with its own date and time, the Terms version, the wording shown, the masked webhook, the feed and the IP address, keeps every record, and shows it on your agreement. PayoutProofs does not ask for, store, check or enforce the amount of any limit you set, and the step does not change any Strategy Signal. Whether and how to set a limit is your decision, and trading without one increases your risk of large losses.
4.8 No one may configure your automation for you. You may not allow any Analyst, any PayoutProofs staff member, or anyone acting for either of them, to set up, configure, log into or operate your automation service or brokerage account on your behalf, whether in person, by chat, by direct message, by screen-share, by remote access or by any other method, or to tell you what size, multiplier or risk settings to use. General, public instructions on how to connect a webhook, available equally to all subscribers, are not prohibited. If anyone offers this kind of help, decline and report it under Section 1.3.
4.9 Monitor your account. Automation is not a self-running system. You are responsible for actively monitoring your Strategy Signals, your automation settings, your open positions, working orders and protective stops, and your broker connection, and for confirming that they behave as you intend. Missed payments, expired connections, broker-side changes and the other events in Section 10.2 can interrupt or change what happens in your account.
5.1 Educational tools only. PayoutProofs may offer a position size calculator, and a what-if view that shows how an Analyst’s recorded Strategy Signals would look at a risk amount or contract count you type in. These are general arithmetic tools.
5.2 Not connected to delivery or your account. Amounts you enter are not requested as your actual account or automation settings, are not used in any Strategy Signal or its delivery, and are not used for marketing. If an amount is remembered between visits, it is kept only as a display preference. Results are hypothetical, are not a recommendation of any size, are shown before commissions, fees and slippage, and do not account for gaps, margin or execution. The disclosure in Section 6.3 applies to them.
6.1 How records are kept. PayoutProofs records each Strategy Signal with a reference price from its market-data feed to produce each Analyst’s public record. Those records are not your fills and are not the results of any customer account. Your brokerage result may be lower, or a loss, when a record shows a win, because of slippage, spreads, commissions and fees, latency, rejected or partial orders, missing protective orders, margin effects, your own sizing or your own changes to a position.
6.2 Analyst Feed and Day-Close Feed results. Each Analyst’s public record reflects the Analyst Feed, that is, the Analyst’s own exits. Results on the Day-Close Feed can be better or worse than the Analyst’s record because positions are closed at 4:50 PM ET rather than when the Analyst exits. Where PayoutProofs shows Day-Close Feed results, they are labeled separately and accompanied by the disclosure in Section 6.3.
6.3 Required disclosure.
THESE RESULTS ARE BASED ON SIMULATED OR HYPOTHETICAL PERFORMANCE RESULTS THAT HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE THE RESULTS SHOWN IN AN ACTUAL PERFORMANCE RECORD, THESE RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, BECAUSE THESE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THESE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED OR HYPOTHETICAL TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT.
6.4 No representation of future results. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in any Analyst record, feed result or what-if view. Past results, whether actual or hypothetical, do not predict future results.
7.1 Automatic renewal disclosure. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EVERY MONTH AT THE MONTHLY PRICE SHOWN BEFORE YOU SUBSCRIBE UNTIL YOU CANCEL. You can cancel at any time online, as described in Section 8.
7.2 Price. Each Analyst sets the monthly price for his or her subscription. The price, the billing frequency and the date of your first charge are shown before you subscribe. Promotional or discounted prices, where offered, are shown before you subscribe together with the price that applies when the promotion ends.
7.3 Free trial. Where an Analyst offers it, your first 7 days with that Analyst Strategy are free (one free trial per Analyst). Unless you cancel before the trial ends, your payment method is charged the monthly price on the day the trial ends and on the same date each month after (or the last day of a shorter month). Before your trial converts to a paid subscription, we will send you any reminder notice that applicable law requires.
7.4 Billing. Payments are processed by our payment provider (currently Whop) using the payment method you provide at checkout. If you subscribe without a trial, your first charge is made on the day you subscribe.
7.5 Confirmation. After you subscribe, we send you a confirmation you can keep, by Discord direct message, stating the Analyst Strategy, the feed you chose, the monthly price, the billing date, the free-trial end date (if any) and how to cancel. Every agreement version is also listed and downloadable under Transactions in the web room.
7.6 Price changes.
(1) New subscribers. An Analyst may change the price for new subscribers at any time.
(2) Your existing subscription. When an Analyst raises the price, the Analyst chooses one of two options for existing subscribers: (a) your price stays, meaning you keep paying the price you accepted for as long as your subscription continues without interruption; or (b) new price from your next renewal, under the rules below.
(3) Notice. For any change to the price of your existing subscription, whether higher or lower, we notify you by Discord direct message and in the web room when the change is made, stating the current price, the new price, the renewal date from which the new price applies and how to cancel. For a higher price, we also send a reminder about 3 days before that renewal date if you have not yet accepted it.
(4) Higher price. A higher price applies to you only if you affirmatively accept it (the Accept button in the web room) before your next renewal date. If you do not accept it by then, your subscription ends on that date and you are not charged again. Section 8.3 applies to any position still open.
(5) Lower price. A lower price applies to you automatically from your next renewal date.
(6) Missed notices. Keeping Discord direct messages from PayoutProofs open helps you receive notices. If a notice does not reach you, you are still never charged a higher price unless you have accepted it.
7.7 Failed payments. If a charge fails, delivery of new Strategy Signals pauses and your subscription is switched off until the payment is completed. Section 4.9 applies to any position still open.
8.1 One-tap online cancellation. You can switch any subscription off at any time, online, with one tap in the web room or through your payment provider account. Cancelling is never harder than subscribing, and you will not be required to call, chat with or contact anyone to cancel.
8.2 Effect of cancelling. Cancelling before a renewal date stops the next charge. Cancelling during a free trial means you are not charged. You keep access until the end of the period already paid for. A paid month is not refunded in part, except under Section 9 or where applicable law requires a refund.
8.3 Open positions. If your subscription ends for any reason while a position opened on an Analyst’s Strategy Signal is still open, PayoutProofs continues to deliver that Analyst’s Strategy Signals for that position, under the feed in effect when its entry was sent, until it is closed, so that you are not left without exit instructions. You remain responsible for managing your position at your broker.
Every charge appears in Transactions. You may report a billing error within 30 days of the charge through the Report button or at [email protected]. If we confirm the error, we refund it to your original payment method. Nothing in this Section limits any right you have under applicable law or under your payment provider’s or card issuer’s policies.
10.1 Futures risk. Futures trading involves substantial risk of loss and is not suitable for everyone. Futures are highly leveraged: a small amount of money controls a position of much greater value, so you can lose a large amount very quickly, and your losses can exceed the amount you deposited with your broker and can be larger than a stop-distance calculation suggests. Trade only with risk capital, meaning money you can afford to lose. Do not trade with money you need for living expenses, retirement, emergencies, education, a home, or money borrowed through student loans or mortgages.
10.2 Automation and technical risks. By connecting a webhook to automation, you accept the technical and market risks of live automated trading, including, for example: (1) Strategy risk — a strategy that performed well in the past or in a what-if view may perform differently in live markets; (2) Connectivity risk — internet outages, webhook failures or network problems can stop signals from reaching your automation or broker, or stop you from seeing what your automation is doing; (3) Configuration risk — errors in your own settings can cause unintended, repeated or oversized orders, runaway activity, or a failure to trade or exit when expected; (4) Market risk — volatile or unusual markets can cause poor fills, rapid losses, trading halts or delayed openings; (5) Data risk — delayed, broken or inaccurate market data, including erroneous trade or quote information, can cause signal or routing errors; (6) Execution risk — orders, changes and cancellations can be rejected, delayed, partially filled, duplicated or not filled at all, and a broker, exchange or regulator can disallow trades without warning; a stop may be rejected, filled at a worse price, cancelled by a later message or never placed; a Session-Close Instruction may be delayed, rejected or not acted on, and a position may remain open into the session close; (7) Third-party changes — brokers, automation services, data providers and other third parties can change or discontinue their systems, connections or rules without notice; (8) Security risk — unauthorized access to your accounts, devices, credentials or webhook can cause unwanted orders or losses; (9) Latency and slippage — delays anywhere in the chain can cause you to miss intended entry or exit prices. These events can contribute to the loss of all or a substantial part of the funds in your account, and automated losses can happen faster than manual ones. Verify positions, working orders and protective stops at your broker; automation is not a substitute for supervising your account.
10.3 Prop firm, evaluation and other accounts. If you send Strategy Signals to a proprietary trading firm account, an evaluation or challenge account, a simulated account or any other non-standard brokerage arrangement, you alone are responsible for following that firm’s or program’s rules, including any limits on automation, copying other traders’ signals, third-party tools or API connections, and holding positions at certain times. PayoutProofs does not promise that using its signals or its delivery is allowed under any firm’s or program’s rules, and is not responsible for any rule breach, failed evaluation, lost funding, closed account or other consequence of using PayoutProofs with such an account.
10.4 Your decision. You alone decide whether to subscribe, which Analyst Strategy to follow, which feed to use, whether to connect a webhook, whether and how to set a daily loss limit, whether to act on any Strategy Signal, and in what size.
11.1 Age. You must be at least 18 years old to subscribe. By subscribing you confirm that you are.
11.2 One person per account. Each account and each subscription is for one individual. You may not share your login, your subscription or your Strategy Signals with anyone else, let anyone else use your account, or pool a subscription among several people. An entity may hold an account only through one designated individual.
11.3 No forwarding or resale. Strategy Signals are for your own use. You may not forward, publish, resell or redistribute Strategy Signals, or send them to any account other than one you own or for which your broker has formally granted you trading authority.
11.4 Account security. You are responsible for keeping your login details confidential and for all activity in your account. Tell us promptly at [email protected] if you believe your account or webhook has been used without your permission.
11.5 Suspension. We may suspend or end your access, without refund for the current period, if you break Section 4.8 or this Section 11, or if we reasonably believe your account is being shared or used unlawfully. Section 8.3 applies to any position still open.
PayoutProofs is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, timeliness or uninterrupted delivery. Reference prices, records, delivery status, Session-Close Instructions, what-if views and calculations can contain errors or be delayed.
13.1 Excluded damages. To the maximum extent permitted by law, PayoutProofs, its owners, staff and the Analysts are not liable for any trading loss, lost profit, lost opportunity, or indirect, incidental, special, consequential or punitive damages arising from a Strategy Signal, a Session-Close Instruction, its delivery or non-delivery, a reference price, a record, the calculator or a what-if view, a third-party service, a broker, an exchange, a funded-account rule, or your use of or inability to use the service, under any theory of liability.
13.2 Cap. To the maximum extent permitted by law, PayoutProofs’ total liability for all claims relating to strategy subscriptions in any twelve-month period is limited to the subscription charges you paid in that period.
13.3 Non-excludable liability. Some jurisdictions do not allow certain exclusions or limits; in those, they apply to the fullest extent allowed. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for violations of law that cannot be waived.
You agree to indemnify and hold harmless PayoutProofs, its owners and staff from third-party claims, losses and costs (including reasonable legal fees) arising from your automation or broker settings, the security of your account or webhook, your funded-account or broker agreements, any sharing or forwarding prohibited by Section 11, or your breach of these Terms, except to the extent caused by PayoutProofs’ own negligence, fraud or wilful misconduct.
We may change these Terms by posting a new version with a new version date and notifying you in the web room or by Discord DM. A change to price, billing or how charges are made takes effect for you only when you affirmatively accept it, and Section 7.6 governs price changes. A change to the time or rules of the Session-Close Instruction takes effect only for positions opened after at least 5 trading days’ notice. Section 16.11 governs changes to the arbitration agreement. Other changes take effect for Strategy Signals delivered after the new version is posted. Each subscription records the version date it was made under.
16.1 Scope. This Section applies to any dispute, claim or controversy between you and PayoutProofs arising out of or relating to these Terms, your subscription, the platform, any Strategy Signal or any charge (a “Dispute”). It governs Disputes relating to strategy subscriptions and controls over any dispute provision in the PayoutProofs Terms of Service.
16.2 Try to resolve it first. Before starting arbitration, the party with the Dispute must send the other a written notice describing the Dispute and the relief requested. Notices to PayoutProofs go to [email protected]; notices to you go to the contact details on your account, including by Discord direct message. Your notice must include your name and your account details. Both parties will try in good faith to resolve the Dispute for 30 days after the notice is received before starting arbitration.
16.3 Binding arbitration. Except as provided in Sections 16.4, 16.6 and 16.8, any Dispute not resolved under Section 16.2 will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect (the “AAA Rules”), as modified by this Section. The AAA Rules are available at www.adr.org. A single arbitrator will decide the Dispute. The arbitration will take place by video or telephone or on written submissions unless the arbitrator decides an in-person hearing is necessary, in which case it will be held in the county where you live or another place we both agree to. The arbitrator may award any individual relief that a court could award and must follow these Terms and applicable law. Judgment on the award may be entered in any court with jurisdiction.
16.4 Small claims. Either party may instead bring an individual claim in small claims court if the claim qualifies and stays there on an individual basis.
16.5 Fees. Payment of filing, administration and arbitrator fees is governed by the AAA Rules, and PayoutProofs will pay any fees those rules require the business to pay. Each party pays its own attorneys’ fees and costs unless applicable law or the arbitrator’s award provides otherwise.
16.6 Class action and jury trial waiver. YOU AND PAYOUTPROOFS EACH AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND PAYOUTPROOFS EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding, except as provided in Section 16.9. If this class action waiver is found unenforceable as to any claim, then that claim, and only that claim, will be decided in court under Section 17 and not in arbitration.
16.7 30-day right to opt out. You may opt out of this agreement to arbitrate by emailing [email protected] within 30 days after you first accept a version of these Terms that contains this Section 16. Your email must state your full name, your account details (your Discord username) and that you decline the arbitration agreement. If you opt out, Disputes will be decided in court under Section 17, and the rest of these Terms still apply. Opting out does not affect any separate arbitration agreement you may have with us.
16.8 Public injunctive relief. If you bring a claim for public injunctive relief that, under applicable law, cannot be waived or required to be arbitrated, that claim will be decided in court under Section 17, after the arbitration of all other claims is complete, and the court proceeding will be paused until then.
16.9 Mass filings. If 25 or more similar demands for arbitration are filed against PayoutProofs by or with the help of the same or coordinated counsel, they will be administered under the AAA’s procedures for mass arbitrations then in effect, and the parties will cooperate in good faith to resolve them in batches efficiently.
16.10 Government complaints. Nothing in these Terms prevents you from filing a complaint with, or providing information to, the Commodity Futures Trading Commission, the National Futures Association, a state attorney general or any other government agency.
16.11 Changes to this Section. If we make a material change to this Section 16, you may reject that change by emailing [email protected] within 30 days after the change is posted, in which case the version of this Section 16 you previously accepted continues to apply to you.
16.12 Federal Arbitration Act. This Section 16 is governed by the Federal Arbitration Act.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, and by applicable federal law. Any Dispute that is not arbitrated under Section 16, and any action to compel arbitration or to confirm, modify or vacate an award, will be brought in the state or federal courts located in Middlesex County, Massachusetts, unless applicable consumer protection law gives you the right to bring it where you live. Nothing in these Terms removes any protection given to you by the consumer protection laws of the state where you live.

The following step appears on the webhook setup screen. The checkbox is required and unticked, and PayoutProofs does not ask for the amount of any limit.
Step: Set a daily loss limit. Set a daily loss limit in your broker’s or automation tool’s risk settings before you connect a webhook. PayoutProofs does not check or enforce it.
[ ] I have set a daily loss limit in my broker’s or automation tool’s risk settings, or I understand the risk of trading without one.
Not legal or investment advice. Futures trading involves substantial risk of loss and is not suitable for everyone.
